環境法における費用負担について, 原因者負担原則が公共負担原則よりも優先するものと考えられている。その理由としては, ①環境保全の実効性の確保の観点, ②経済的効率性の観点, ③公平性の観点があげられるが, ①が最も重要な理由であり, ②は特に汚染防止費用について有効な理由であること, ③は多くの場合に最も有力であるが, 同時に警察法, 租税法, 民法の帰責原理を排除するものでないことに留意する必要がある。拡大生産者責任は汚染者負担原則と関連性を有しており, 両者はカラブレイジィの最安価費用回避者の考え方によって統一的に理解できよう。
In the apportionment of the costs in environmental laws, the polluter-pays-principle is considered to override the public-cost sharing principle. 
The reasons are: (1) to secure the effective protection of the environment; (2) to keep economic efficiency; and (3) to achieve overall fairness. Reason (1) is the most important. 
Reason (2) is an especially valid for the costs of pollution. 
Reason (3) is the most influential in most cases, but we should note that it does not preclude the principle of liability found in the Police Law, Tax Law, and Civil Law. 
Extended producer responsibility is related to the polluter-pays-principle, and both concepts can be uniformly understood by the notion of the "cheapest cost avoider" advocated by Professor Calabresi.
