この研究は、無体財や集合的利益などの新たな財の登場に対して、狭隘で静態的な古典的物権法体系が十分な対応をなしえていないという認識を基礎に、「財の多様化」「帰属関係の多様化」「財の法の柔軟化」をキーワードとしつつ、財の法の基礎理論を構築し、それを踏まえた民法物権法に対する基本的スタンスをどうするのか、とい基礎問題に取り組むことを目指したものである。
この研究は、すでに財の法の基礎理論に関して、科研費研究と協力した結果、①吉田克己・片山直也編『財の多様化と民法学』（商事法務、2014年）として結実している。今年度は、具体的な物権法改正提案をすべく、鋭意研究を進めた。その結果、2019年度中には、②吉田克己・金山直樹・片山直也編『物権法の改正提案とその基礎理論』（仮題、成文堂）を出版する予定である。
この過程で浮上してきたのが、人口減少社会の到来を背景とする所有者不明土地問題である。この問題と密接に関連する負財概念については、すでに上記①においても扱っている。しかし、所有者不明土地問題の深刻化によって、さらなる理論的深化の必要性が強く感じられるに至っている。
基本的な方向性としては、無体物に関する規定を民法に入れるにしても、形式的なものしか盛り込むことができないという点では、異論は見られない。ただ、その上で、だから無意味であるという立場と、象徴的にしろ民法典に規定があること自体が大切だという立場の対立が見られる。結局は、民法典が何を規定すべきか、という法典論の基本問題に立ち返って検討することになる。
さらに、当面の改正提案を試みたが、意外と改正すべき点が少ないことが判明した。それは、実務で安定的に運用されている制度については、それを尊重すべきであると考えられることが主な要因である。新たな制度は、むしろ特別法によって、必要な制度とともに、構想されるべきだと考えられるからである。けれども、具体的な構想までには至っていない。
This research is based on the idea that the narrow and static classical property rights system does not sufficiently respond to the emergence of new goods such as intangible goods and collective interests. "Diversification of property relationship" is a key word to construct a basic theory of the law of goods.
This research has already come to fruition as "Diversification of goods and civil law" (shoji-homu, 2014) as a result of collaborating research on basic theory of the law of goods. We have carried out intensive research in order to make a concrete proposal for amendment of the property rights law. As a result, in 2019, we plan to publish "Proposals for Revising the Property Law and its Basic Theory" (provisional title, Seibundo) edited by Katsumi Yoshida, Naoki Kanayama and Naoya Katayama.
What has emerged in this process is the land issue of unknown owner as the background of the depopulation society. The negative goods concept is closely related to this issue. With the aggravation of the owner unknown land problem, the need for further theoretical deepening has come to be felt strongly.
There is no objection to the fact that even if the civil law stipulates provisions on intangibles, only formal ones can be included. However, on that basis, there is a contradiction between the positions: According to one, it is meaningless; according to the other one, it is important that there is a rule in the civil code itself, even just a symbolic one. In the end, we will go back to the basic question of the code theory, what the civil code should prescribe.
Furthermore, although we tried to make a revision proposal for the time being, it turned out that there are very few points that should be revised unexpectedly. The main factor is that the system that is stably operated in practice should be respected. This is because a special legislation, rather than a reform of MInpo, should be conceived together with the creation of necessary institutions. However, we have not reached a concrete idea.
