本研究期間中においては、第一に、TPP協定の成立に伴い我が国の商標法上導入が求められるにいたった法定賠償制度について、すでに国内法において対応する制度を有するアメリカ法との比較研究を行った。TPP協定は、曲折を経て、2018年12月末に我が国ついて発効し、商標法の改正を施行されている。
第二に、特許法に新設され、商標法にも同様の制度が置かれる方向で検討が進められている新しい証拠収集手続き［査証制度］について、すでに国内法上対応する制度を有するEU諸国の法律の比較法的研究を行った。査証制度は、当初、侵害訴訟提訴前に、裁判所の任命による専門家が被告の施設等を査察し、報告書を裁判所に提出する仕組みとして構想された。この構想に対しては、被告の負担の重さ、特許権者である原告側による濫用の危険性など強い反発が経済界中心に寄せられ、政府での検討を経て、最終案としては、侵害訴訟の提起後に、被告の意見をも聞いたうえで、他の証拠収集手段では得られない等の厳格な要件を満たす場合についてだけ、実施される制度となる見込みであり、2019年国会に改正案が提出済である。
以上、法定賠償制度と、査証制度の新設により、商標権の権利行使の実効性が担保されることが大いに期待される。

With respect to this concept, strong opposition such as heavy burden of defendant and danger of abuse by plaintiff who is the patent owner is strongly centered on the business world, and after examination by the government, it is considered that the final draft is After filing a lawsuit, after hearing the opinion of the defendant, it is expected that the system will be implemented only if it meets strict requirements such as can not be obtained by other means of evidence collection. A proposal has been submitted.
As described above, it is highly expected that the legal compensation system and the establishment of the visa system will ensure the effectiveness of the exercise of trademark right.
