本研究は, これまでわが国においてあまり紹介されることのなかったアメリカの移民法制について, 包括的に検討することを目的として行われた。研究期間は3年間であった。第1年次は, アメリカにおける移民法と移民政策の歴史的関係に焦点を合わせ, その特色を指摘した。第2年次は, わが国におけるアメリカ移民法制の研究動向を調査した。第3年次は, 第1年次と第2年次の成果をもとに, 現在のアメリカにおけるオバマ大統領による移民法制改革問題を取り上げ, 権力分立の観点から検討した。
The aim of this research was to analyze the American Immigration Law and Policy as generally and deeply as possible. As Japan inevitably plunges into the aging country, the lessons which development of the American Immigration Law and Policy provides are very valuable for Japan. With this concern, the research has been carried out over the three years. First year, the research focused on the historical development of the American Immigration Law and Policy and found that three characteristics had been there, namely the preferential treatment of white immigrants over the Asian immigrants. Second year, the focus of this research puts on the question how far the Japanese Immigration Policy has been analyzed by researchers. The outcome is not encouraging.Third year, based on the results of the first and the second year, the Dream Act issue was analyzed in connection with the President Obama's presidential orders.
