| Abstract |
本研究は、実際の憲法規範の内容形成はどのように個別領域ごとに機能分化し、それは日独間でどのように共通しあるいは相違するのかを考察することであった。その際、ドイツにおいては、憲法規範がそれぞれの個別規範の歴史や思想に立脚した原理原則の小命題に翻訳され、そのいわば中二階的な命題をめぐる解釈論の対立で具体的な事案が処理されているという仮説を立て、その妥当性を個別分野ごとのドイツ連邦憲法裁判所の判例分析を通じて論証することを目指した。４年間の研究を通じて、ドイツにおける憲法規範が個別領域ごとにどのように機能分化しているかを明らかにし、日本の憲法学との比較を通じてその異同を明らかにすることができた。
The purpose of this research is to consider how the actual content formation of constitutional norms is functionally differentiated for each individual domain, and how it is common or different between Japan and Germany. Through four years of research, I clarified how constitutional norms in Germany are functionally differentiated into individual areas, and through comparison with Japan, I was able to clarify the differences.
