本研究は、国際的な民事紛争解決が終局的に解決されることの意義を検討することを主眼においたものである。具体的には、民事訴訟法118条が予定している、民事事件に関する確定判決の意義を、その他の民事紛争解決手段（仲裁や調停）との比較を通じて、検討するものである。また、外国判決が承認されない場合（国際的な判決の相互矛盾）に生じる、国際的な不当利得の問題も検討を試みた。
The purpose of this study is to examine the significance of the ultimate resolution of international civil dispute resolution. Specifically, the significance of the final judgment in civil cases contemplated by Article 118 of the Code of Civil Procedure will be examined by comparing it with other means of resolving civil disputes (arbitration and mediation). We also tried to examine the problem of international unjust enrichment caused by non-recognition of foreign judgments.
