| Abstract |
消費者契約法制、消費者信用法制を題材に、①消費者法は何を目指す法制なのか、②法規範の存在形式の意義、③隣接諸科学（経済学、行動経済学等）と法学の協働の在り方、④目的達成に必要な規範形成、諸手段の選択、⑤立法の事前・事後評価という課題に取り組んだ。
研究成果として、効率性概念の意義の明確化を図り、経済学や行動経済学を用いて消費者契約法制および消費者信用法制について問題の特定と解決策の提言を行い、ルールvs.スタンダード論などを踏まえた立法の形式に関する考え方の明確化し、法の実現主体の選択・協働のあり方について、整理・提言を試みた。
Regarding the consumer contract legislation and consumer credit legislation, We tackled the following challenges:①what is the consumer law aimed at, ②the significance of the existence form of legal norms, and ③collaboration of economics, behavioral economics and law,④better mix of regulatory measures ⑤pre- and post-evaluation of legislation.
As a research result, we clarified the significance of the concept of efficiency, identified problems and proposed solutions to consumer contract legislation and consumer credit legislation using economics and behavioral economics, and based on rule vs. standard theory etc., we clarified the way of thinking about the form of legislation, and tried to organize and propose the way of selecting and collaborating with regulatory measures.
