本稿の目的は、世界各国で導入されている交際費の損金不算入制度を分析的に検討することである。損金不算入となる交際費を世界的に比較すると、国によって税制が異なることがわかる。交際費の全額を損金算入する国、全額損金不算入とする国、一部のみ損金算入とする国など、国によって交際費の損金算入が異なる。
具体的に、本稿の研究目的は大きく2つある。第一に、損金不算入割合は報酬契約にどのような影響を与えるのか。第二に、より重要なこととして、交際費の損金不算入割合はなぜ国や時代によって変化してきたのか。本稿では、税務当局の行動を考慮し、損金不算入割合を内生化することで、この問題を説明する。本稿の主な結果は以下の通りである。損金不算入割合が外生的な場合、法人税率や損金不算入割合が上昇するとエージェントへの努力インセンティブの効率が低下するため、プリンシパルはインセンティブ係数を低下させる。一方、損金不算入割合が内生的な場合は、法人税率の上昇はインセンティブ係数を上昇させるが、これは損金不算入割合が外生的な場合とは逆である。理由は、損金不算入割合が内生的な場合に法人税率が上昇すると、税務当局は損金不算入割合を下げることで企業活動を活性化し、税収を確保しようとするためである。
The purpose of this study is to analytically examine the non-deductible part of entertainment expenses introduced in various countries worldwide. A global comparison of non-deductible entertainment expenses shows that the tax systems differ by country. Some countries make all the entertainment expenses deductible, some make these expenses entirely non-deductible, and others make only a portion of the expenses deductible. This study thus has two main research objectives. First, how do nondeductible expenses affect the compensation contract? Second, and more importantly, why has the non-deductible ratio of entertainment expense changed across countries and over time? Considering the behavior of the tax authority, we explain this issue by endogenizing the non-deductible ratio. The main results are as follows. When the non-deductible ratio is exogenous, the principal reduces the incentive rate when the corporate tax rate or the non-deductible ratio increase, since a rise in the corporate tax rate or the non-deductible ratio reduces the efficiency of incentivizing the agent. By contrast, when the non-deductible ratio is endogenous, a rise in the corporate tax rate increases the incentive rate, which is opposite to the case where the non-deductible ratio is exogenous. This is because, if the corporate tax rate increases when the nondeductible expense ratio is endogenous, the tax authority tries to stimulate business activities and secure tax revenues by lowering the non-deductible ratio.
