日本の比較憲法研究は、①英米独仏などの特定国に隔たっており、②基本的に対象国の理論や学説の紹介が中心で、③憲法典の制定・改正は研究対象とせず、④ドメスティックな研究が中心で、日本の憲法状況を海外に発信することは稀である。これに対して、近年、世界的に興隆を見せている比較憲法研究では、①特定国に隔たらず、②他の学問領域の研究手法を積極的に取り入れ、③憲法典を所与とせず、④国際的な交流を盛んに行っている、正反対の状況にある。
本研究は、世界水準の比較憲法研究の議論を踏まえて、日本の憲法学で議論されてきた論点や、十分に検討されてこなかった論点について明らかにするとともに、それらについて発信することを試みた。
まず、世界水準の比較憲法学の知見を踏まえて、日本の憲法学の議論状況を相対化し、新たな視点を提示する研究として、法学教室誌の「探検する憲法」という連載を挙げることができる。次に、日本の憲法状況を海外に英語への発信として、定評のあるオンライン・ジャーナルであるGerman Law JournalにConstitutional stability in japan not due to popular approvalという論文を掲載した。
本研究は、３ か年計画で立案したものであり、いまだ途上にあるが、１年目の成果として十分な業績を示せたのではないかと考える。
Comparative constitutional research in Japan focuses only on the U.S, Germany, France, and England. Other countries are usually not the subject of research. And Japanese constitutional law scholars are not interested in how to enact or amend the constitution. In contrast, Comparative Constitutional Studies around the world are focus on every country and compare them, and interested in the process of constitutional enactment and the best way to the amendment.
In this research, I try to change the environment of Japanese comparative constitutional studies based on global standard research. I published many articles, including "Constitutional stability in japan not due to popular approval", for that purpose.
