本年度は，民法整備国際協力の対象国のうち，ベトナムに焦点を当て，①1986年のドイモイ（刷新）政策の策定前後における政治・経済・社会状況と1995年民法典制定との関係，②1995年民法典制定に対する国際協力の方法としての共同研究型の形成，③1995年民法典の成果と問題点（裁判所・検察院・弁護士等による個人・企業の権利保護の実態の変化，市民のための法律普及プログラムの実際，判例の公開等），④2005年民法典の制定経緯と共同研究型協力の実態，⑤2005年民法典の成果と問題点，⑥2015年民法典の制定経緯と共同研究型協力の実態，⑥2015年民法典の成果と問題点を分析し，民法整備協力のベトナム型の抽出を試みた。その結果，ベトナムは1986年にドイモイ（刷新）政策を採用していち早く市場化に乗り出し，1992年に改正憲法に従い，多セクター制の経済構造に転換すべく，1995年に民法典を制定した（838か条。1996年施行）。もっとも，これは政府の計画に従って生産と分配を行う社会主義の下で，政府の計画によらない非社会主義セクターによる取引を規律するに止まり，契約自由を承認してはいなかった。その後，経済成長が続き，市場化政策が成果を生むに従い，2005年に民法典を改正し（777か条），契約自由の原則を初めて承認した。さらに，2015年の改正民法典（689か条）は，世帯や組合の法人格を否定して権利主体を個人と法人に限定し，無権利者・無権限者から事情を知らずに取得した者の保護を強化する等，取引安全を重視するに至った。その背景には，外国投資による開発プロジェクトの増加が経済成長を牽引している事情がある。こうしたベトナムの民法整備は，政府が経済政策を実施し，経済成長を牽引するために社会をリードする手段となっており，それに対する民法整備のための国際協力は，最も間接的で助言的提供型ともいうべき特色をもつに至っている。
Vietnam adopted the Doi Moi (renewal) policy in 1986 and quickly launched its market-socialism under the revised 1992 Constitution, which led to the enactment of the Civil Code in 1995 to transform the Vietnamese economy into a multi-sector economic structure, in accordance with the revised constitution. However, under the socialism which produces and distributes according to the government's plan, it has not approved of the freedom of contract. After that, as economic growth continued and the marketization policy produced results, the Civil Code was revised in 2005, and the principle of freedom of contract was approved for the first time. In addition, the further revised Civil Code in 2015 denied the legal personality of households and partnerships, restricts the subject of right to individuals and corporations, and strengthened the interests of a third party who transacted with the party to contract without the knowledge that the party held no right to transfer the property. Thus it put emphasis on the protection of the third party and the protection of transactions. In the background of the increase in development projects, the foreign investments are the major driving force of the economic growth. In this circumstances, the Vietnamese Civil Code has become a means by which the government will implement economic policy, and it will intend to lead society to the further economic growth. In this context, the international cooperation for civil law reform in Vietnam has been the most indirect and advisory style of the cooperation for civil law reform.
