本研究は, ラテンアメリカ諸国において市民法の基礎となる民法典の制定経緯とその歴史的背景を明らかにするものである。ラテンアメリカの地理的・文化的範囲を手掛かりに, 対象国をスペイン語圏18か国とブラジルそしてハイチの計20か国と措定し, また, その独立期法典化の歴史的範囲として, 南北アメリカ初の法典化を達成したルイジアナ民法典に続くラテンアメリカ初の法典化となる1826年ハイチ民法典から1916年ブラジル民法典までの約100年間を対象とし, フランス法典への依存が次第に希薄化し, 翻って植民地時代のインディアス=カスティーリャ旧法が見直されていく過程を素描するとともに, その法典化の要因について考察した。
This research focuses on Civil Law Codification in Latin America from historical and cultural perspectives. In the research, we explored how the French influence on the codification was faded and the Spanish Castilian law during the colonization of the Americas was re-evaluated in the eyes of local intellectual figures such as Andres Bello, Augusto Teixeira de Freitas and Dalmacio Velez Sarsfield served mostly as an individual author in our targeted countries : 18 Spanish speaking countries, Brazil and Haiti.
