2019年9月12日、欧州連合司法裁判所(the Court of Justice of the European Union 以下「ECJ」という。)Cofemel - Sociedade de Vestuário, SA v G-Star Raw CV, C-683/17, EU:C:2019-721先行判決 (以下「Cofemel判決」という。)は、衣服等のデザインについても、他の類型の著作物についてこれまでECJ判例が示してきたものと同様の基準によって著作物性が判断されるべきであり、したがって、加盟国の著作権法上、デザインの保護について、実用的目的を超えた、特段の美的に顕著な視覚的効果の存在を要件とすることは、EU情報社会指令(Directive on the harmonisation of certain aspects of copyright and related rights in the information society) に違反する、と説示した。
長くECJの判断が俟たれてきた重要論点に関する判断であり、大きな反響を呼んでいる。本年度は、本判決を中心にEU著作権法上の著作物性概念について研究した。
