本研究課題では、1966年にアメリカの情報公開法 (FOIA) が制定された要因と意義について、市民の「知る権利」の充足が強調されてきたのに対して、新しい見方を打ち出した。情報公開への社会的圧力に加え、議会が大統領および行政機関を統制する誘因を持っていたことがFOIAの立法につながったこと、そしてその目的に向けてこれまで注目されてきた連邦議会下院ではなく、上院側が大きな役割を果たしてきたことを示し、FOIA制定の過程と意義について新たな見方を打ち出した。
This research project has presented a fresh perspective on the legislation of the 1966 US Freedom of Information Act. The existing research emphasizes the pressure from actors, both inside and outside the government, emphasizing the citizens' right to know as the cause of the legislation. While this research does not contest the importance such a political movement, it demonstrates that congress had a strong interest in controlling discretionary policy implementation by administrative agencies through the accountability reform legislation. This research also highlights the role played by the U.S. senate, especially its Judiciary Committee, in the legislation, in addition to the well-documented legislative campaign led by Rep. John Moss.
