Analyzing the establishment of the UNESCO Intangible Cultural Heritage Convention and the Act on Protection of Cultural Properties, this paper examines a conflict between cultural property administration and folk performance stakeholders when folk performance is designated as a cultural property. I consider an example that is designated as an Important Intangible Folk Cultural Property in 1976 and listed on the UNESCO Intangible Cultural Heritage Representative List in 2011.
I analyze stakeholders' feelings about Sada Shin Noh being listed on the Representative List and about "folk performance's degeneration" through the establishment of the UNESCO Intangible Cultural Heritage Convention and the Act on Protection of Cultural Properties. I consider the reasons for folk performance's degeneration as structural problems rooted in cultural property administration.
I analyze the establishment process focusing on two political measures surrounding folk performance: the UNESCO Intangible Cultural Heritage Convention enacted in 2003 and the Act on Protection of Cultural Properties enacted in 1950 and amended in 1975. Furthermore, I discuss the amendment of the Act on Protection of Cultural Properties of 1975, which affected the establishment of the UNESCO Intangible Cultural Heritage Convention, as a cause of the problems surrounding folk performance.
The history of the revision of the Act on Protection of Cultural Properties can be defined as the history of seeking folk performance's position in "intangible folklore" and "intangible cultural heritage." Herein, folk performance is at the mercy of political movements such as the Association of Shinto Shrine.
