本年度は、2021年4月に所有者不明土地また管理不全土地についての対策に関わる民法物権法の改正がなされ、この点の研究を行なった。また、それ以外の物権法の部分の立法論的研究も引き続き行なった。更には、担保物権法の分野において、集合物を担保とする方法をめぐって立法が検討されている段階であり、近い将来立法が予定されている。その点につき、立法論的な検討を行ない、立法に対して意見を発信するための研究を行なった。物権法分野については、平野は、『物権法』の改訂を行ない、2022年春頃に出版の予定である。また、片山は、担保法の改定のため、2021年9月に成立したフランスの担保法改正を研究し、ベルギー改正法についても研究を行なった。また、片山は、法務省の法制審議会における立法案の検討作業の委員であり、担保法改正に関わっている。
This year, in April 2021, the Civil Property Rights Act related to measures for land of unknown owners and land that undermanaged land was revised, and this research was conducted. He also continued to conduct legislative studies of other parts of the Property Law. Furthermore, in the field of the Collateral Rights Act, legislation is being considered over methods for securing aggregates, and legislation is scheduled in the near future. In this regard, we conducted legislative examinations and conducted research to disseminate opinions on legislation. In the field of property law, Hirano revised the Property Rights Act and plans to publish it around spring 2022. In addition, Katayama studied the revision of the French Security Law enacted in September 2021 in order to revise the Security Law, and also researched the Belgian Amendment Law. In addition, Katayama is a member of the Legislative Council of the Ministry of Justice to review the legislation and is involved in the revision of the Security Act.
