人格権に由来してその外延に形成される判例法上の権利利益の事例研究として，プライバシーに係る情報の適切な管理についての合理的な期待の保護に関する調査研究を実施した。解釈論上の提案として，情報の「適切な管理」について事業者が負う義務の理論的根拠を，信義則に基づくものとして理解するならば，秘密保持義務だけでなく，情報開示義務をも基礎付けることができることを示した。研究成果は，情報通信学会第38回学会大会での発表を経て，情報通信学会誌において査読論文として公表することができた。この論文に関連して，パーソナルデータ＋α研究会およびリテール決済研究会においても報告の機会を得た。
また，インターネット上における権利侵害に対する救済について調査研究を実施した。研究成果は，情報通信学会大会第39回学会大会において発表することができた。
これらの研究を踏まえて，パブリシティ権の一身専属性について，調査研究を実施した。米国では，パブリシティ権の性質を財産権として譲渡可能性を当然視する見解が多数を占めているが，死後におけるパブリシティ権の存続については，州による差異が大きい。これを認めていないニューヨーク州では賛否両論の運動が錯綜しており，2007年，2017年および2018年の3回にわたり州法改正法案の成立が見送られた。研究成果は，情報通信学会第40回学会大会において発表を予定している。
As an example of the case law rights derived from the rights of personhood, I conducted research on the protection of reasonable expectations for the appropriate management of information concerning privacy. I demonstrated that the protection stems from the duty of good faith and it can be developed beyond the confidentiality obligation towards the disclosure obligation of business operators as information fiduciaries. The result of the research was presented at the meeting of the JSICR and published as a paper in the journal of the JSICR. In connection with this paper, I also have the opportunities to report at the Personal Data +alpha Study Group and the Study Group on Retail Settlement.
Based on these studies, I conducted research on the Inalienability of the Right of Publicity. In the United States, the commonly accepted theory have considered the right of publicity as transferable, but there are large differences among states with regard to the postmortem right. In New York State, which does not recognize the postmortem right, the Legislature failed to pass the state law revision bill three times in 2007, 2017 and 2018. The research results will be presented at the meeting of the JSICR.
