| Abstract |
戦後日本の高度経済成長期は「奇跡」とよばれた。その要因として挙げられた日本の高貯蓄率と低失業率は, 日本経済に備わった構造的な特徴ではないことが高度成長期終焉後の経済統計によって確認されている。しかし, 産業政策の功罪に伴う談合体質という日本経済に内在する特徴は依然として今日まで根深く残り, 現在も独占禁止法違反事件という形で新聞紙上を賑わせている。本分析で明らかになった点は, 入札方法, 予定価格設定に工夫が必要であると同時に, 予算と決算両面の分析が不可欠であるということである。談合による経済の非効率と不公正を是正していくことは経済学と法学に課せられた将来的な共通のテーマであろう。
