| Abstract |
本稿は、参議院の多数を野党が占める分裂議会の発生が官僚の立法準備行動にどのような影響を及ぼしたのかを明らかにするため、特許庁が2007年7月に分裂議会が発生する前の2006年常会に提出した意匠法等の一部を改正する法律案と、分裂議会が発生した後の2008年常会に提出した特許法等の一部を改正する法律案の立法過程を比較分析した。両法案はいずれも政治的に争点化することなく、野党からの賛成も得て国会を通過した法案であったが、本稿の分析結果は、分裂議会の発生前後で特許庁の官僚の法案根回し行動に大きな差異があることを示した。
