本研究は, EU消費者法の平準化をめぐる新たな展開を分析し, それを踏まえて, 消費者法の実体法規のあり方や, 消費者の権利の実現および被害救済を実効化するための手続的な仕組みのあり方について, 体系性という視点を加えて検討を行うことを目的とした。この目的のため, 本研究では, EU消費者私法の平準化の促進を目的とする新たな動向, とりわけ, ①消費者権利指令, ②ヨーロッパ共通売買法規則提案, ③不公正取引方法指令, ④消費者団体訴訟制度などにつき, EUレベルと各国レベルの双方から分析し, また消費者法の体系化や構造化をめぐるヨーロッパにおける議論についての検討を行った。
This research project aims to analyze the new development of the Harmonization of EU Consumer Law and to pursue the ideal situation of the consumer material law and procedural law for the effective enforcement of the consumers' right, with the viewpoint of system and construction of the consumer law. For this purposes, the research team has analyzed especially (1) Consumer Right Directive, (2) the Proposal of the Common European Sales Law, (3) Unfair Commercial Practices Directive, (4) the scheme to promote the access to Justice: Organization litigation or Class action for the consumers. The team has also examined the discussion in the European countries on the systematization of Consumer Law.
