本研究課題では、アメリカで大統領によって指名・任命される連邦レベルの裁判官のうち、下級審の裁判官について、20世紀後半からの二大政党のイデオロギー的分極化がその性格をどう変えたのかを分析した。とくに控訴審裁判所に、行政官経験者の任命が顕著に増えていることが明らかになった。行政官としての活動から政策的な考え方が周囲に知られているのに加え、政権の政策執行を支える経験を通じて大統領の広範な権力行使を容認する姿勢を身につけているという期待が、そうした人事の背景にあると考えられる。
This project addressed how the ideological polarization of the major parties in the US has altered the characteristics of federal lower court judges, who are nominated and appointed by the President. Particularly noteworthy is the substantial rise in the appointment of lawyers with experience working within the executive branch, primarily as government lawyers, to appellate courts. Two reasons drive these appointments. First, the policy preferences of these lawyers are widely recognized by fellow partisans, enabling the president to nominate them with confidence. Second, and more significantly, it is anticipated that these lawyers have developed a disposition to support the extensive use of presidential power through their experiences in the executive branch.
