| Abstract |
本研究では、消費者法の体系的構築の可能性を追究するため、EU消費者法の平準化をめぐる新たな展開を分析した。特に焦点を当てたのは、消費者権利指令、単一デジタル市場に向けたEUの立法動向、消費者団体訴訟制度などである。
これらの分析を踏まえて、消費者法の実体法規のあり方や、消費者の権利実現・被害救済を実効化するための手続的な仕組みのあり方について、体系性という視点を加えて検討を行った。
The purpose of our research was to seek for the possibility of systematization of consumer law. For this purpose, we have examined the new developments of EU consumer law concerning its harmonization and then examined the structure and the contents of consumer material law and procedural law related to the realization of consumer rights, from the viewpoint of the systematization of consumer law. With regard to the above, we have focused especially on (1) consumer rights directive, (2) new EU rules towards the single digital market and (3) consumer group litigation system, and analyzed them. Based on this analysis, we have discussed the core points for the systematization and effectiveness of consumer law.
