| Abstract |
民事紛争解決手段として, メディエーションを含む代替的紛争解決手段と訴訟手続との対比を行うことで, 紛争解決における国家と私人の役割を検討した。
その際, ヨーロッパのメディエーション規則を含むADR法制を紹介・検討することで日本法の解釈論の示唆を得, また, 外国判決承認制度との比較検討を行うことで私的紛争解決制度の利便性, 簡易迅速な紛争解決といった特色を確認することができた。
This Study focused on the Role of Nation (Civil Procedure) and Private Person (Alternative Dispute Resolution) in case of Private Dispute.
To achieve the aim of the study, I have analyzed the European System of ADR (not only including Arbitration but also Mediation) in Europa. Furthermore, the advantages of ADR, namely flexibility and rapidity, will be confirmed in comparison with the Recognition of Foreign Judgment.
