| Abstract |
判例をデータにしながら経済の理論的・実証的分析を行う。ここで判例の役割と判例を使った経済の実証分析の可能性を検討し，分析例を提示する。経済学は理論モデルを基本的な道具にするが，法学では法律の条文が分析の基本的な道具となる。それを踏まえ，経済学と法学の間に存在する方法論の相違や術語の定義について考察する。その上で経済学と法学のアプローチは違っているが，経済学と法学の究極の目的には共通点があることを指摘する。
