1968(昭和43)年に制定された都市計画法については, 都市計画史研究や都市法研究の分野で, 法の制定を促した時代背景, 制定までの経緯, 制定された法の内容とその問題点についての検討が重ねられてきたが, このうち特に, そうした時代背景の詳細や, 指摘される法の問題点が制定までの過程でどの程度議論されたのかといった点については, 十分な検討がなされているとは言い難い。本稿は, こうした点を念頭に, 当時の新聞・雑誌や省庁間での議論, 国会での審議などの分析を通して, この都市計画法の制定を検討するものである。
Regarding the City Planning Act enacted in 1968, in the field of urban planning history research and urban law research, various considerations were raised in the background leading to the enactment of the law, its contents and their issues; however, it is hard to say whether the details of such historical background and the level of debate identified issues in the process toward law enactment have been properly considered.
This study, while considering these points, considers the enactment of the City Planning Act through an analysis of newspapers, magazines, debates among government agencies, deliberations in the Diet, etc. from that time.
