米国の離脱に象徴されるように, 京都議定書は, 途上国参加問題のほか, 固定的な国別排出数量を定めてこれを義務化していること, かつ, 次期約束期間からの超過分の差し引きという形で遵守強制をかけようとしている点で, 深刻な問題を内包している。本稿では, 国際法の観点から, それらの問題を洗い直した上で, 2013年以降の新たな枠組につき, WTO/GATTモデルを参考にしながら構想する。
There are serious inherent issues in the Kyoto Protocol, as symbolized by the defection of the United States.
The Protocol mandates a fixed emission volume by country and to enforce it by deducting the excess amount from the following mandatory period, besides the issues surrounding the non-participation of developing countries.
This study considers those issues from the international law perspective and formulates a plan for a new framework to be effective after 2013, referencing the WTO/GATT model.
