著量だけでなく人を対象とする医学的実験をも含めた,広い意味での医療が行われる際の不可欠の前提として,病名と病状,そして行おうとする治療や実験について,まず医師が分かりやすく説明し,患者ないし被験者は十分に理解した上で,これを受けることに自分の意志で同意すること,このことが「インフォームド・コンセントinformed consent」すなわち「情報を与えられた上での同意」と呼ばれる原理であり,現在これが医療の場において,医師と患者ないし被験者との間の倫理的な規範として定着することが求められている.この小論の課題は,まず第一に,このインフォームド・コンセントの原理が,一方では実験に際しての医師の自己規制として,また他方では医療訴訟における法理として主張され,やがて医師と患者の間の倫理規範として求められるに至る歴史的過程を瞥見し,またこれを通して,この原理の倫理的な基礎をなすものを明らかにすることにある.またこの原理と,同じく医療上の重要な原理とされる「医師の裁量権」との関係が,しばしば議論の的にされているが,インフォームド・コンセントの原理の倫理的基礎を踏まえるなら,こうした関係はどう調整されたらよいのか,これを考察することが第二の課題である.
The principle of informed consent was claimed on one side as a professional norm of medical scientists by experiment on human beings and on the other side as a legal obligation on physicians by medical treatments. To establish a relationship of mutual trust and respect between physicians and patients, this principle is held as a ethically necessary condition in health care in general today. In this paper, after a brief review of a history of codes or declarations concerning the principle of informed consent, its ethical foundation is sought for in the conception of autonomy or self-decision-making; this is asserted by deverse modern philosophers as ethically indispensable for human freedom and adopted by modern civil society as an essencial rule for individual conducts. This ethical foundation gives the self-determination of patients a preference over the discretion of physicians. It means that even an unpleasant information like having cancer should be disclosed, if and so far as a patient wants to know it, and that prior to a particular disclosure his wish to know or not about his status of health should be conveyed to his physician.
