本研究の目的は，政権党に所属する参議院議員の活動に着目して，日本の政治過程において参議院がどのように機能しているのかを明らかにすることである。3年計画の3年目にあたる2023年度においては，昨年度と同様に自民党の参議院議員によって組織される参議院自民党を対象として，それが自民党内においてどの程度の自律性を有しているのかを実証的に検討した。その成果のひとつが松浦淳介「参議院自民党の人事と首相権力」（『法学研究』97巻1号所収，2024年）である。
本稿では，参議院自民党の執行部人事と参議院内人事を対象として，参議院自民党による人事の自律性を長期的に分析した。具体的な役職は，前者は議員会長，幹事長，政審会長，国対委員長，後者は議長，副議長，議院運営委員長，予算委員長である。まず，参議院自民党内における各派閥のポスト獲得状況を確認した結果，佐藤栄作の派閥に連なる佐藤派系が55年体制期のみならず，その崩壊以降も他の派閥に対して一貫して優位にあることが明らかになった。その一方で，自民党の総裁によって率いられる，いわゆる総裁派閥は各ポストにおいて一定の割合を占めているものの，佐藤派系に大きな差をつけられることがほとんどであり，1990年代以降，総裁の制度的権力が強化される中においてもその状況に大きな変化は見られなかった。
また，ここで対象とした各ポストについて，それぞれの役職に就く参議院議員の当選回数と在任期数を見たところ，55年体制期と55年体制後における平均当選回数は各ポストにおいてほぼ不変であり，平均在任期数についても参議院議長などは55年体制後に短くなる傾向にあったが，その他は大きな変動がなかった。これらのことは，参議院自民党の人事慣行として，当選回数に基づくシニオリティ・ルールが形成されていることを示すとともに，議長職もまた参議院自民党内の人事の一環として制度化されたことを示唆している。
The purpose of this study is to clarify the influence of the LDP in the House of Councillors, which is organized by members of the House of Councillors who belong to the LDP, in the Japanese political process. To this end, this study focuses on the LDP's personnel management and the operation of the House of Councillors to clarify that the LDP in the House of Councillors has a high degree of autonomy as an actor within the LDP. In 2023, the last year of the three-year research plan, we analyzed how the LDP in the House of Councillors formed its personnel practices. The research results are reported in Matsuura (2024).
In the paper, we examined how autonomously the LDP in the House of Councillors conducts these appointments, focusing on the appointments of cabinet ministers, the LDP in the House of Councillors' executive committee, and the LDP in the House of Councillors' executive officers. As a result, it became clear that the LDP in the House of Councillors has formed its own personnel practices and that even the LDP executive cannot easily intervene in its personnel affairs.
