日本においては、裁判官も弁護士も、憲法訴訟に不慣れな者が多い。原告側の主張も、未成熟ないしは本筋を外した議論となっていることが少なくなく、また、最高裁を含む裁判所の判決も、予見可能性や追従可能性に乏しい、あるいは個別事例的衡量に終始することが少なくない。憲法学が学説と実務との間の乖離が顕著な分野であると指摘される所以である。本研究の目的は、弁護士には法的構成の手掛かりを、裁判官には類型化と論点整理の手掛かりを与えることにより、学説と実務との間の橋渡しをし、日本の憲法訴訟の質的向上に貢献しようというものである。なお、本年度は３年計画の３年目であり、本研究は各年度において、理論的研究と実践的研究を並行して行ってきた。
本研究は、①基本権制約論、②基本権の内容形成論、③救済方法、という３つの切り口から、法的構成の再検討を試みるものである。本年度の成果は、小山剛「憲法上の個人情報保護についての基本的な考え方」『現代憲法学の理論と課題――野坂泰司先生古稀記念』（信山社、2023年）189頁において公表した。これは、名古屋地裁に提出した意見書を一部修正のうえ掲載したものである（名古屋地判令和4年1月18日参照）。また、小山剛「憲法上の権利の制限と内容形成：夫婦同氏性を例に」法学研究97巻２号（2024年）１頁では、婚氏、婚姻の自由に関するドイツの憲法判例と比較検討することにより、新たに提起された夫婦別姓訴訟（第三次訴訟）への示唆を与えた。小山剛「妊娠中絶とリプロダクティブ・ヘルス／ライツ――ドイツの憲法論を中心に」法律時報96巻4号（2024年）4頁では、憲法上の権利として成立する範囲を限定的に示すとともに、リプロダクティブ・ヘルス／ライツという問題設定をすることの意義について述べた。
この他、未刊行のものとして、最高裁大法廷宛の意見書「優生手術と国家賠償――立法・司法による憲法17条の具体化の視点から」を執筆した。また、引き続き憲法訴訟に携わる弁護士への助言や意見書の提出を行っており、本年度は、新たに旅券発給拒否処分などに関係した。
In Japan, many judges and lawyers are unfamiliar with constitutional lawsuits. Plaintiffs' arguments are often immature or off-topic, and court decisions, including those of the Supreme Court, often lack foreseeability and followability, or are limited to individual case-by-case balancing. This is the reason why constitutional law is said to be a field in which the gap between academic theory and practice is conspicuous. The purpose of this study is to contribute to the qualitative improvement of constitutional lawsuits in Japan by providing lawyers with clues for legal construction and judges with clues for categorizing and organizing issues, thereby bridging the gap between academic theory and practice. Theoretical research and practical research are conducted concurrently.
This study attempts to reexamine the legal structure from the three perspectives of (1) the theory of constraints on fundamental rights, (2) the theory of shaping the content of fundamental rights, and (3) the method of remedy. I wrote three papers in this year. First, “Basic concept regarding the protection of personal information under the Constitution” in “Theory and issues of modern constitutional law (Gendai Kenpo-gaku no riron to kadai)” is a partially revised version of the written opinion submitted to the Nagoya District Court. Second, “Restrictions and design of constitutional rights” in Hogaku Kenkyu 97(2). In this paper, I compare Japanese cases with German cases of constitutional precedents regarding the freedom of marriage and provided suggestions for the suit for married couples with different surnames (third suit). Third, “The abortion and the reproductive health / rights” in Horitsu Jiho 96(4). In this paper, I wrote about significance of the reproductive health and rights.
In addition, we continue to provide advice and opinion letters to attorneys involved in constitutional lawsuits this year.
