現在わが国において，触法精神障害者の量刑がどのように評価され，その背景にある刑罰思想がいかなるものなのかが問題となっている。しかし，ドイツの議論を参考に展開されてきたこれまでの量刑理論は，抽象的な議論にとどまっており，裁判実務において，これらを直接的な指針として用いることは困難である。これまでの量刑理論は，「責任とは何か」という形而上学的な命題から演繹的に導出された基準を提示することに終始し，実務における理論の適用可能性を度外視する傾向があったためである。
本研究は，イギリス（イングランド・ウェールズ）刑法における量刑論について，現地でのリサーチ等を通じて歴史的背景や理論的根拠を対象とした研究を行うことにより，近時の実務で大きな問題となっている，触法精神障害者に対する量刑の判断枠組みを明らかにすることを目的としている。
本年度も，前年度に引き続き，現在の量刑実務において問題となっている事象を正確に把握するために，万引き再犯のケース（摂食障害やクレプトマニアによる万引き再犯）について，責任能力や量刑が争われた事案を中心に分析を加えた。この成果は，後掲研究業績「『万引き』と責任非難・量刑」の形で論文化した。翌年度は，重大犯罪に焦点を絞った上で，精神障害と量刑の問題を引き続き検討する予定である。
In Japan, the question is being raised as to how the criminal sentencing of persons with mental disorders are evaluated and what kind of penal philosophy is behind such evaluations. However, the past theories of sentencing, which were developed with reference to German law, remain abstract discussions, and it is difficult to use them as a direct guideline in court practice. This is because the previous theories of punishment tended to present criteria deductively derived from the metaphysical proposition of "what responsibility is," and tended to disregard the applicability of the theories in practice.
The purpose of this study is to clarify the framework of sentencing for the defendants affected by mental disorder, which has become a major issue in recent practice, by conducting research on the historical background and theoretical basis of the theory of sentencing in English (England and Wales) criminal law through on-site research and other means.
In this fiscal year, as in the previous year, I continued my analysis of shoplifting recidivism cases (shoplifting recidivism due to eating disorders and kleptomania), focusing on cases in which insanity defense and the sentencing were disputed, in order to accurately grasp the events that are problematic in current sentencing practice. The results were published in a paper entitled "'Shoplifting', Blame and Sentencing" in the later section of this report. In the following year, I plan to continue examining the issue of mental disorder and sentencing, with a focus on serious crimes.
